These Terms and Conditions (“Terms”) govern the user’s (“You” or “Your”) access to and use of the website, services, and any associated content provided therein. By using our website and associated services (collectively, the “Service”), you agree to comply with these terms.
Please read these Terms and Conditions carefully. If you do not agree with these terms, you should not access or use the website and its services.
2.1. By accessing, browsing, visiting, registering for, or using the website and its services, you accept and agree to be bound by these terms and any other terms and policies referenced herein.
2.2. Your continued use of the website and its services constitutes your acceptance of these terms.
For the purposes of these Terms and Conditions, the following definitions shall apply:
3.1. “CPQ” means Configure-Price-Quote, a business process aimed at streamlining product configuration, pricing, and quote generation.
3.2. “QTC” means Quote-To-Cash, a process that covers the entire sales lifecycle from quote generation to payment collection.
3.3. “User” means any individual who accesses, interacts with, registers, or uses the CPQ Mastery website, whether as a Guest, Member, Contributor, or Administrator.
3.4. “Guest” means any individual who visits the Website but has not registered for an account or logged in. Guests have access to public content and can navigate the Website but are restricted from accessing secured features, such as forums, e-learning educational services, professional services, or premium content available only to Members.
3.5. “Member” means any individual who has registered for an account on the Website and has logged in. Members have access to secured content and features of the Website, including participation in forums, access to premium educational materials, and the ability to purchase e-learning educational services. Membership levels may vary, granting different access rights depending on the level of subscription.
3.6. “Consultant” means a qualified individual or entity engaged by CPQ Mastery LLC to provide expert advice, guidance, or specialized knowledge related to CPQ and QTC processes. Consultants may offer services such as training, strategic planning, implementation support, and other consulting services to enhance user experience and operational efficiency on the Website.
3.7. “Contributor” means a registered Member who has been granted the ability to create content for the Website, such as blog articles, learning courses, or other educational materials. Contributors must submit their content for moderation and approval before it is published and made available to the public or Members.
3.8. “Moderator” means a registered Member with the authority to review and edit content submitted by Contributors. Moderators are responsible for ensuring that content adheres to the Website’s standards and may request changes or directly edit content to ensure compliance. Moderators also have the authority to manage discussions in forums, including the ability to delete posts or close topics as necessary.
3.9. “Approver” means a Member with the authority to approve content for publication on the Website. Approvers must provide feedback to Contributors on any necessary corrections and may only approve content submitted by others. They cannot approve their own submissions unless they hold additional administrative privileges.
3.10. “Administrator” refers to a Member who has control over the configuration of the Website and its functionalities., including plugins and customization features. Administrators may also manage user roles and have full access to all content on the Website. The Founder of the Website shall hold all Administrator rights, which cannot be revoked.
3.11. “Content” includes text, images, audio, video, and any other material provided on the Website by CPQ Mastery LLC or users.
3.12. “Services” refers to the educational, consulting, and networking services offered by CPQ Mastery LLC through the Website.
CPQ Mastery provides a variety of services through its Website, aimed at evangelizing and promoting knowledge and mastery of Configure-Price-Quote (CPQ) and Quote-To-Cash (QTC) processes. The Services are available to individual users, corporate clients, and community members and include, but are not limited to, the following:
4.1.1. Social Networking Platform or Community: CPQ Mastery facilitates professional networking opportunities for individuals and businesses. A professional network focused on CPQ and QTC expertise, allowing users to connect, share knowledge, and collaborate. Features may include but are not limited to public and private discussion forums, community feeds, group discussions, and other networking tools.
4.1.2. Discussion Forums: A platform for asynchronous communication, where users can post, follow, and contribute to discussions on various CPQ and QTC topics. Moderators will ensure the quality and relevance of discussions.
4.1.3. Professional Services: We offer a range of paid professional services aimed at helping businesses optimize their CPQ and QTC processes. These services are designed to address specific business needs and include but are not limited to:
4.1.3.1. CPQ Health Checks: Comprehensive assessments of your existing CPQ implementation to identify potential areas for improvement, provide performance optimization strategies, and ensure best practices are followed.
4.1.3.2. Quick Start Implementations: Tailored services to assist businesses with the rapid implementation of CPQ solutions, including system setup, configuration, and initial training.
4.1.3.3. One-on-One Expert Sessions: Personalized consulting sessions with our team of experts, designed to address specific CPQ challenges and provide expert guidance for optimal implementation and maintenance.
4.1.4. E-Learning & Training Services:
4.1.4.1. Online Courses: Educational resources, including pre-recorded courses and live training & consulting sessions, covering various CPQ and QTC topics. Some courses are available for a fee and may require successful competition of quizzes to obtain a completion certificate. Courses may offer completion certificates.
4.1.4.2. Live Instructor-Led Classes: Limited enrolment classes conducted in a live streaming format, available for purchase based on scheduled dates.
4.1.5. E-Commerce: CPQ Mastery-branded merchandise and professional services available for purchase, including but not limited to, consulting packages, CPQ implementation tools, and company-branded products.
4.1.6. Blogs: Users may access blog content as part of their membership, and while they are encouraged to share blog posts within the community, they may not reproduce or distribute the content without express permission from us. We are not responsible for the opinions or advice expressed in user-generated blogs, and users should exercise discretion when relying on blog content for decision-making.
4.1.7. The Career:
4.1.7.1. The Career section of our website offers users a platform to post and search for job opportunities.
4.1.7.2. Job Listings: We offer a job board that enables members to post and apply for job openings within the CPQ and QTC sectors. CPQ Mastery does not participate in job placement and assumes no liability for interactions between employers and candidates.
4.1.7.3. CPQ Mastery’s own Job Listings: From time to time, CPQ Mastery may post job listings on the platform for its own internal hiring needs, whether for employee or contractor positions. Any such listings will be clearly identified as being posted by CPQ Mastery. In these cases, CPQ Mastery will manage the recruitment and hiring process directly. However, we reserve the right to modify or remove any listings at our discretion and make no guarantees regarding the hiring outcome for applicants.
4.1.7.4. Users who post job listings are responsible for the accuracy and legality of the listings.
4.1.7.5. We do not participate in the recruitment process and are not liable for any claims or disputes arising between employers and candidates.
4.1.8. Membership Subscriptions: Various membership levels granting access to additional premium content, services, and perks.
5.1.1. To use our Services, you must be:
5.1.1.1. at least 18 (Eighteen) years old or the age of majority in your jurisdiction, whichever is greater,
5.1.1.2. Competent to enter into a contract under applicable laws. 5.1.1.3. By using our Services, you represent and warrant that you meet these eligibility requirements. If you do not meet these requirements, you must not use our Services.
5.2.1. Our services are not directed toward children under the age of 13, and we do not knowingly collect or solicit personal information from children under 13 in compliance with the Children’s Online Privacy Protection Act (COPPA).
5.2.2. If we become aware that we have inadvertently collected personal information from a child under 13 without verified parental consent, we will take immediate steps to delete such information.
5.2.3. If you believe that we might have any information from or about a child under 13, please contact us at support@cpqmastery.pro.
6.1.1. Account Creation
6.1.1.1. To access certain features and services on the Company website and premium content, you must first register for an account (“Member Account”). Guests may access public content but will not have access to premium features. CPQ Mastery reserves the right to change, with or without notice, which areas of the site are considered premium content and therefore only accessible to registered members.
6.1.1.2. By registering for a Member Account, you confirm that the information you provide during the registration process is accurate, complete, and up to date. You agree to promptly update your account details should there be any changes.
6.2.1. CPQ Mastery operates with a single user account but utilizes the concept of persona to manage access levels and roles on the website. Each user can have one or more personae, which control what they can view and do on the platform. The personae define the roles a user holds, and these roles can be cumulative. The personae and roles assigned to each member determine how the member is allowed to interact with the platform. Below is an explanation of the key personae:
6.2.1.1. Guest Persona: A Guest persona applies to any unregistered individual who visits the website. Guests can access free and public content but do not have access to premium or secured content or other advanced features of the website.
6.2.1.2. Member Persona: The Member persona applies to users who have created an account and logged into the website. Members can access both public and secured content, which is unavailable to Guests. Members are required to purchase a subscription to gain access to specific content or services. Each membership level has its own access controls, dictating which protected content the Member can view or engage with. Some membership levels may require you to purchase a paid subscription.
6.2.1.3. Contributor Persona: Members with the Contributor persona can create content such as blog posts and learning courses. Contributors have limited “admin” functions for such content, which must go through a moderation and approval process, before being published for Guests or Members to view. Contributors cannot approve or moderate their own content.
6.2.1.4. Moderator Persona: Moderators have the authority to review, edit, and moderate content created by Contributors. This includes communicating with Contributors for necessary content changes, correcting errors directly, and managing content in forums (including deleting inappropriate posts). Moderators, however, cannot moderate their own content if they are also Contributors.
6.2.1.5. Approver Persona: Approvers have the authority to approve content submitted by Contributors. They must communicate any rejections and provide feedback to Contributors for revisions. Like Moderators, Approvers cannot approve their own content but may approve content submitted by other users.
6.2.1.6. Administrator Persona: Administrators manage the configuration of the website, plugins, and user roles. The Administrator persona grants control over site operations, content moderation, and system customizations.
6.2.1.7. Cumulative Personae: Users can hold multiple personae simultaneously. For example, a user can be both a Member and a Contributor or a Moderator. However, restrictions apply to ensure that Contributors cannot moderate or approve their own content unless they also hold the Administrator persona.
6.2.2. CPQ Mastery reserves the right to determine which personae are assigned to each individual member, based on how they want to interact with the networking platform. In some situations, members may be allowed to request being assigned specific personae. CPQ Mastery reserves the right to reject such requests with or without justification.
6.3.1. Upon successful registration, Users are encouraged to complete their profile by providing additional information such as professional background, skill set, and areas of interest using an “About Me” option on their profile. This profile information will help tailor your experience on the platform and will help you make higher quality connections with other members.
6.4.1. We may, at our discretion, allow you to register using third-party authentication services such as Google or LinkedIn. In doing so, you authorize us to access and use certain personal information provided by the third party to create your account. We will handle such information in compliance with the Privacy Policy.
6.5.1. You may update or correct your account information at any time by logging into your account and accessing the “My Account” settings. You must ensure that your contact information, especially your email address, is always current to avoid missing important notifications or updates.
6.6.1. If your account is tied to a subscription plan you may manage your subscription, including upgrading or downgrading plans, through your account settings. Changes to your subscription, including billing cycles and access levels, are subject to the Payment Terms.
6.7.1. Users are solely responsible for maintaining the confidentiality of their account information and password. Users are also responsible for all activities that occur under their account. We will not be held liable for any loss resulting from unauthorized use of the account.
6.8.1. Users are prohibited from maintaining more than one account, unless managing a corporate account as well. Each account is strictly personal and cannot be transferred or shared with third parties.
6.9.1. Users are strictly prohibited from any unauthorized use of accounts or sharing their account credentials, including their username and password, with any other person or entity.
6.9.2. Sharing account information with others, or allowing others to use the account, is considered a serious violation of these Terms and Conditions.
6.9.3. Any violation of this rule will result in consequences, which may include, but are not limited to, temporary suspension or permanent ban from the platform, without prior notice.
6.9.4. We reserve the right to take legal action against individuals involved in account sharing or any other unauthorized use of accounts, to the fullest extent permitted by law.
7.1.1. CPQ Mastery offers different membership subscription plans with various levels of access to services, features, and content. CPQ Mastery reserves the right to offer, or not offer, a free membership level.
7.2.1. By purchasing any products, services, memberships, or subscriptions from CPQ Mastery, you agree to pay all applicable fees as outlined on the Website. Payment is due at the time of purchase unless otherwise specified in these Payment Terms or an applicable agreement.
7.2.2. All fees and charges are in U.S. dollars (USD) unless stated otherwise. Users are responsible for any currency conversion fees, foreign transaction fees, or other related costs imposed by their payment provider.
7.2.3. Membership subscriptions will automatically renew at the end of each billing cycle unless cancelled by the User. Users may receive prior notifications before auto-renewal.
7.2.4. Downgrades and upgrades to subscription plans will be object to proration pricing, and changes will take effect immediately. When downgrading, the prorated paid remainder of the prior subscription, if any, will be automatically applied to future renewals.
7.2.5. No refunds will be provided for account terminations or cancellations.
7.3.1. We accept payments through secure payment gateways, including but not limited to credit/debit cards (Visa, MasterCard, American Express, Discover), PayPal, and any other payment methods indicated at checkout.
7.4.1. For subscription-based services, We may offer monthly or annual billing cycles. Payments are processed automatically at the beginning of each billing cycle, and Users must provide valid payment information to maintain access to the subscribed services. Users may receive prior notifications before auto-renewal to update payment information, if necessary.
7.5.1. Payments are processed by third-party payment processors, and by providing your payment information, you authorize CPQ Mastery and its payment processor to charge the payment method you provide. CPQ Mastery is not liable for payment processing errors or breaches by the payment processor.
7.6.1. All sales are final, and refunds are only provided under specific circumstances outlined in this document. We do not offer refunds for partially used memberships, subscription services, or other one-time purchases unless otherwise specified.
7.7.1. If a subscription payment fails, we will notify you, and you will have five (5) business days to update your payment method and ensure payment is made. If payment is not received within the specified time, we may suspend your account and deny access to the services until payment is completed.
7.8.1. If any payment method is declined or fails for any reason, including expired payment methods or insufficient funds, it is your responsibility to provide updated payment information. We reserve the right to charge a service fee for repeated failed transactions.
7.8.2. Repeated failed transactions may incur a service fee, and we reserve the right to charge a reactivation fee if the account is suspended.
7.9.1. We reserve the right to suspend access to your account and associated services if payment is not made on time. Suspended accounts may be reinstated once all outstanding balances are settled.
7.10.1. Prices displayed on the Website do not include applicable taxes. You are responsible for any sales, use, value-added, or other taxes applicable to your purchase based on your location. If you are located in the United States of America, any such sales taxes will be calculated and added at checkout.
7.11.1. If you are purchasing services or products from outside the U.S., you are responsible for any import duties, tariffs, or taxes imposed by the authorities in your country. We are not liable for any additional charges or delays due to customs processing.
7.12.1. We reserve the right to change pricing for subscriptions, services, and products at any time. Users may be notified in advance of any price changes that affect their subscriptions or services.
8.1. By accessing or using our website you agree to comply with these Terms and Conditions, as well as all applicable laws, regulations, and guidelines. Failure to adhere to these Terms may result in the suspension or termination of your account and access to the website.
8.2. You are responsible for providing accurate and complete information during the registration process and ensuring that all information remains up to date. This includes, but is not limited to, your name, contact number, email address, billing information, and any other required account details.
8.3. You are responsible for maintaining the confidentiality of your account credentials, including your username and password. You must not share or disclose your account credentials to any third party. You agree to notify us immediately if you become aware of any unauthorized use of your account or any breach of security.
8.4. You are responsible for paying all applicable fees for products, services, and subscriptions as outlined in the Payment Terms. You agree to provide valid and up-to-date payment information and ensure that all payments are processed in a timely manner. Failure to meet payment obligations may result in the suspension or termination of your account, and we reserve the right to take legal action to recover any outstanding balances.
8.5. You acknowledge that through the Career section on our website, CPQ Mastery primarily acts as a platform connecting job seekers and employers. Employment contracts or negotiations are conducted independently of CPQ Mastery, except in cases where We post our own job listings, which will be clearly identified as such. In those instances, CPQ Mastery will directly manage the recruitment process. For all other listings, we do not participate in the recruitment process and are not liable for any claims or disputes arising between employers and candidates. We reserve the right to remove job postings that are fraudulent, misleading, or in violation of our terms and conditions.
8.6. You agree not to engage in any of the following activities while using the website:
8.6.1. Posting or sharing unlawful, abusive, harassing, defamatory, threatening, or otherwise objectionable content.
8.6.2. Uploading content that infringes on the intellectual property rights of others, including but not limited to copyrights, trademarks, and patents.
8.6.3. Using the Website to distribute malware, viruses, or other harmful computer code.
8.6.4. Impersonating another person or entity or falsely stating or misrepresenting your affiliation with a person or entity.
8.6.5. Engaging in spamming, phishing, or any unsolicited advertising or marketing activities.
8.7. Any content you post or share on the Website, including forum posts, course discussions, or comments, must adhere to our terms and applicable laws. You are responsible for ensuring that the content you submit does not violate any third-party rights or applicable laws. We reserve the right to remove or modify, with or without justification and with or without notice, any content that we deem inappropriate or in violation of these Terms.
9.1. As a registered user of CPQ Mastery, you may have the opportunity to submit, post, upload, or otherwise provide content to the Website, including but not limited to any public or private community feeds, forum posts, comments, blog articles, course materials, reviews, feedback, and other contributions (“User- Generated Content”).
9.2. You retain ownership of any content that you submit, but by providing such content to the Website, you grant CPQ Mastery LLC a worldwide, non- exclusive, royalty-free, perpetual, irrevocable, and sublicensable right to use, reproduce, distribute, display, modify, create derivative works from, publish, and promote such content across its platform, related services, and external channels, with or without attribution.
9.3. You are solely responsible for the content you submit to the Website, and you represent and warrant that:
9.3.1. The content is accurate, truthful, and complies with these Terms and Conditions.
9.3.2. The content does not infringe upon the intellectual property rights, privacy rights, or any other legal rights of any third party.
9.3.3. You have the legal right to provide the content and grant the rights detailed in Section 9.2 above.
9.3.4. The content does not contain any defamatory, obscene, offensive, unlawful, or inappropriate material.
9.4. We do not pre-screen user-generated content but reserve the right to monitor, edit, or remove any content submitted to the Website at our sole discretion, for any reason, including but not limited to content that violates these terms and conditions, is inappropriate, offensive, or harmful to other users, is unlawful or encourages illegal activity, is spam or advertising that has not been authorized by us.
9.5. We are not responsible for the accuracy, usefulness, or legal compliance of the user-generated content. The opinions expressed by users in their content are their own and do not reflect our views. We assume no liability for any user content or actions resulting from such content.
9.6. We reserve the right to terminate or suspend your account if you submit content that violates these terms or any applicable laws. Any termination or suspension will be in our sole discretion and may result in the forfeiture of access to any content that you have submitted.
10.1. To the maximum extent permitted by applicable law, CPQ Mastery LLC, its affiliates, officers, directors, employees, agents, or licensors shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including, without limitation, loss of profits, data, goodwill, or other intangible losses, arising out of or relating to the User’s access to, use of, or inability to use the Website, any conduct or content of any third party on the Website, any unauthorized access to or use of our website and services, or any bugs, viruses, or harmful content transmitted to or through the website.
10.2. We make no warranties or representations regarding the accuracy, completeness, reliability, or availability of any content or services provided on the website. Any reliance on content, advice, or information provided by us, including through its community feeds, blogs, forums, or consulting services, is done at your own risk. We disclaim all liability for any errors or omissions in the content, and users are responsible for verifying the accuracy and suitability of any content before relying on it.
10.3. We shall not be responsible or liable for any user-generated content, including but not limited to community feeds, blog posts, forum discussions, or any other materials submitted by users. We reserve the right to moderate or remove any content, for any reason, with or without justification. We are not responsible for monitoring all content and shall not be liable for any defamatory, offensive, or illegal user-generated content. Users are solely responsible for the content they post, and we disclaim any liability related to user interactions.
11.1. The User agrees to indemnify, defend, and hold harmless CPQ Mastery LLC, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to the User’s use of the Website, any content submitted by the User, the User’s violation of these Terms and Conditions, or any infringement by the User of any intellectual property or other rights of any third party.
11.2. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by the User, and the User agrees to cooperate fully with us in asserting any available defenses.
12.1. The User agrees to maintain the confidentiality of any proprietary or confidential information provided by us, including but not limited to business plans, trade secrets, and non-public technical or commercial information. The User shall not disclose, share, or make available such confidential information to any third party without our prior written consent of the company, and shall take all reasonable precautions to protect such information from unauthorized disclosure or misuse.
12.2. This obligation of confidentiality shall survive the termination of this agreement and remain in effect indefinitely.
13.1. All intellectual property rights, including but not limited to the website’s copyrights, trademarks, service marks, patents, and trade secrets, its content, and services are owned by or licensed to CPQ Mastery LLC. The User acknowledges and agrees that no ownership of any intellectual property rights is transferred to the User through their use of the Website or services. The User may not use, reproduce, modify, or distribute any content or materials from the Website without CPQ Mastery’s express written permission.
14.1. Our website may contain links to third-party websites, services, or content that are not owned or controlled by us. These links are provided for your convenience only, and we do not endorse or assume any responsibility for the content, privacy policies, or practices of any third-party websites.
14.2. The User acknowledges and agrees that we are not liable for any loss or damage that may arise from the User’s use of or reliance on any third-party websites or services. The User is encouraged to review the terms and conditions and privacy policies of any third-party websites they visit.
15.1. We reserve the right to terminate or suspend the User’s account and access to the Website at any time, with or without cause or notice, for any violation of these Terms and Conditions, applicable law, or other conduct that we deem harmful to our interests and terms.
15.2. Upon termination, the User’s right to use the Website will cease immediately, and any remaining obligations or liabilities incurred prior to termination shall survive, including payment obligations, confidentiality and indemnity.
16.1. In the event of any dispute or claim arising out of or relating to these Terms and Conditions or the User’s use of the Website, the User agrees to first contact CPQ Mastery LLC at support@cpqmastery.pro. to attempt to resolve the issue informally.
16.2. If the dispute is not resolved, the User agrees that the dispute shall be settled by binding arbitration under the rules of the American Arbitration Association, with the arbitration taking place in Houston, Texas, United States of America, and judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.
17.1. We shall not be liable for any failure to perform its obligations under these Terms and Conditions due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, strikes, pandemics, government actions, or any other event that prevents or delays performance.
17.2. In such cases, obligations will be suspended for the duration of the event, and it will resume performance as soon as reasonably possible thereafter.
18.1. Our website and its services are provided on an “as-is” and “as-available” basis without warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the website, its content, or any services will be uninterrupted, error-free, or secure, nor does it guarantee the accuracy, completeness, or reliability of any content posted by users.
18.2. You agree to use the networking, educational, consulting, and professional services provided by CPQ Mastery LLC in a manner that aligns with the intended purpose of such services. You acknowledge that any advice, recommendations, or guidance provided by CPQ Mastery LLC through its services, including but not limited to consulting services, CPQ Health Checks, Quick Start Implementations, or One-on-One Expert Sessions are based on best practices and do not guarantee specific results. Users are responsible for implementing the recommendations provided and assume all risks associated with the use of CPQ Mastery’s services.
19.1.1. These Terms and Conditions are governed by and construed in accordance with the laws of the State of Texas, United States of America, without regard to its conflict of law principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Houston, Texas, United States of America, and the User consents to the personal jurisdiction of such courts.
19.2.1. These Terms and Conditions, along with any policies or legal notices published by CPQ Mastery LLC on the Website, constitute the entire agreement between the User and CPQ Mastery with respect to the use of the Website and services, superseding any prior agreements or understandings, whether written or oral, related to the subject matter hereof.
19.3.1. If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
19.4.1. Our failure to enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of CPQ Mastery.
19.5.1. Any notices or communications required or permitted under these Terms shall be in writing and delivered by email or through the Website’s notification system. Notices to CPQ Mastery should be directed to support@cpqmastery.pro. and notices to the User shall be sent to the email address associated with the User’s account or posted on the Website. It is the responsibility of the User to ensure that their contact information remains current.
